The casino's guests have parked in the cherrick lot, representing approximately 40, 000 vehicles per month. prc-mo had negotiated a validation agreement with the operator of the cherrick lot to accept .25 later raised to .50 ; for use by "admiral" patrons of the cherrick lot. on september 10, 2004, the city of st. louis, missouri commenced an action seeking to condemn the cherrick lot for use by pinnacle which is developing a large gaming and hotel complex approximately one block away from the cherrick lot. at the time the condemnation was commenced, columbia sussex held an option to purchase the cherrick lot for .0 million. on october 26, 2004, columbia sussex exercised its option and purchased the cherrick lot. on november 4, 2005, the unsecured creditors' committee and prcmo filed a verified complaint for declaratory judgment and for injunctive relief in the bankruptcy court in prc-mo's case. on november 10, 2005, the bankruptcy court granted the request and enjoined the condemnation action until january 9, 2006, which date was subsequently extended to january 12, 2006, and thereafter to february 3, 2006, pending further evaluation by the bankruptcy court at a hearing held on february 3, 2006. at the february 3, 2006 hearing, as a result of an agreement reached between pci, debtor and pinnacle as more particularly described below, debtor's complaint against the city was voluntarily dismissed and the related injunction dissolved. on december 16, 2005, columbia sussex notified debtor that the parking rate on the cherrick lot would be increased from .50 per vehicle to .00 per vehicle effective at midnight. on december 22, 2005, debtor was notified of a further rate increase from .00 per vehicle to .00 per vehicle. debtor withheld payment to columbia sussex of all parking fees incurred after the initial rate increase due to debtor's determination that the increases were not justified. on december 30, 2005, columbia sussex responded by ceasing to further honor casino validation for parking and raising the rate to .00 per vehicle to all vehicles parked on the lot. as more particularly described below, in response to columbia sussex's various actions respecting pci and debtor, pci and debtor filed an action in the bankruptcy court against columbia sussex for breach of contract regarding the columbia sussex sale agreement and seeking injunctive relief for rates at the cherrick lot. as more particularly described below, in connection with the pending sale of the prc-mo's stock to pinnacle, pci and prc-mo entered into a letter agreement relating to the cherrick lot. pinnacle currently holds an option to purchase the cherrick lot if it is taken in the condemnation proceeding. pursuant to the letter agreement, the parties agreed that if the cherrick lot is condemned, pinnacle shall exercise its option to purchase the cherrick lot, provided the aggregate price required to be paid as compensation for the cherrick lot does not exceed .0 million. if pinnacle purchases the cherrick lot, whether pursuant to its option or otherwise, pinnacle shall permit patrons of prc-mo the right to park on the cherrick lot for a validation fee not exceeding .50 per day for each vehicle, which arrangement shall extend for a term ending on the earlier of a ; the date on which pinnacle opens its new casino project on laclede's landing, or b ; december 31, 2008. as alluded to above, in consideration for pinnacle's obligations under the letter agreement, the complaint by prc-mo pending against the city of st. louis in the condemnation proceeding was dismissed and the related injunction dissolved. suit against columbia sussex on january 12, 2006, debtor and pci filed a verified complaint for damages and injunctive relief in the bankruptcy court against columbia sussex, inc. and wimar tahoe corporation. plaintiffs allege breach of contract by columbia sussex because it took actions that could reasonably be expected to impede or delay licensure by the missouri gaming commission and it failed to use all commercially reasonable efforts to obtain licensure from missouri gaming commission. plaintiffs' complaint also alleges a prima facie tort in that columbia sussex had unilaterally raised validation rates for the cherrick lot used by debtor for its patrons and with the intent to cause injury to debtor. plaintiffs seek damages for the injury inflicted and an injunction to prevent columbia sussex from raising the validation fee above the .50 per "admiral" patron vehicle charged immediately prior to the increase in fees. plaintiffs also - 37!

The ranks and are being assimilated into the culture of zeta psi through a revamped pledge process. with a large number of our members also participating in basketball at rpi, there has been increasing pressure to avoid any interference between the pledge period and the varsity basketball season. a shorter and more intense program has been implemented that should result in the initiation of seven new brothers by early december. though met with initial hesitancy by the actives, we are excited by the prospects of this new program and how it avails itself to having a strong spring pledge class as well. with rensselaer's clear intention to hold its recruitment period in the spring in the near future, we are also in the process of transitioning our own bidding procedures and have established continuing relationships with many recruits that could be added as members in a very strong spring class next semester. community service has also been a priority at the house this semester, as many members have already donated money to various charities ranging from the united way to the american cancer society. we have also made it a point to participate in some of rpi's charitable events such as the run to remember, which is hosted by the rpi's rotc program in memory of the lost prisoners of war. coming up later this semester is the making strides against breast cancer walk as well as various trips to local soup kitchens and youth clubs. finally, thanks are sent out from all of the actives in the pi chapter to the elders, who put substantial time and money into making key renovations to the house that will ensure its safety and aesthetics for years to come. the balcony was structurally rebuilt, and new gutters were installed with the hopes that they will allow the basement at the chapter house to be refinished in the future. we wish all zetes good luck, health, and prosperity in the present and future.

In the black whirling waters i saw simon's face. "petra!" he screamed. "petra! what's happening?" then i lost sight of him. i had to hold on to something or be swept away. seeing a rooftop, i reached out and grabbed the edges. my legs were sucked under, and all the trash--the wood and metal objects--slammed against my hips and legs. screaming with pain, i hung on. soon the pressure of the water began to ease, so i pulled myself up onto the roof. then, just as quickly as the first, another wave rose up and poured over the rooftop. i lost my grip and was drawn down. i tried to surface. i fought to get some air until i had no breath left. then i stopped fighting and began swallowing the black water. a great feeling of peacefulness came over me. i surrendered to the calmness. i remember thinking, whatever god will decide, it's ok. that's when i was thrust back up to the surface, gasping for air. where was simon? was he ok? i desperately tried to find something permanent to hold on to. when i saw palm trees sticking out of the water, i told myself, get your arms out! i grabbed at a branch, curled my fingers around it, and held on. from the intensity of the pain i was in, i knew that bones were bro.

16 the most straightforward application of the revenue rule arises when a foreign sovereign attempts to sue directly in its own right to enforce a tax judgment in the courts of another nation. such attempts so patently violate the rule that they have been rare in the international setting. 16 for centuries, there has been an established practice that a foreign sovereign cannot sue in another country to enforce its "prerogative" or sovereign rights, such as the right to collect taxes. 17 within the united states, similar attempts by states to enforce their fiscal laws in the courts of other states were long rebuffed. in wisconsin v. pelican ins. co., 127 u.s. 265 1888 ; , the state of wisconsin sought to bring an action in this court to enforce a judgment against a louisiana corporation for penalties it had incurred under a wisconsin regulatory statute. this court held that its original jurisdiction extended only to cases that could have been brought in the courts of the defendant's state, see id. at 289, and that the court lacked jurisdiction over the case in question, because "[b]y the law of england and of the united states the penal laws of a country do not reach beyond its own territory except when extended by express treaty or statute[.]" id. at 289-90. in keeping with pelican ins. co., courts in a number of other cases refused to and texas poker.

97 made a very good shewing, which drew the admiration of all neutral observers. the japanese soon brought reinforcements and extended their front down towards the yangtze in an attempt to dislodge the chinese from their grip on the suburb of chapei; but despite the overwhelming superiority of the japanese equipment, especially in the air, the chinese stuck to their ground all through august and september, until well into october, when they began to crack, and were finally dislodged by a successful landing on the flank in hangchow bay. these operations at first led to a complete breakdown in communications between nanking and shanghai. towards the end of august, however, it was found that cars could cover the 200 miles to shanghai by turning off the main road at soochow, and passing through kashing to the hangchow road, which entered shanghai from the south. as i was badly in need of instructions i decided to motor down. on arrival in shanghai i was astonished at the state in which i found popular foreign opinion. there appeared to be no adequate appreciation of the meaning of these new japanese encroachments in china, or of the japanese threat to the "open door" system of trading the far east, the traditional british policy expressed in lord palmerston's instructions to admiral elliot in 1840, when he said "you will bear in mind that her majesty's government do not desire to obtain for british subjects any exclusive privileges of trade which should not be equally extended to the subjects of every other power". shanghai had for some years been the object of much factious interference and petty vexation on the part of chinese officials in their campaign to recover their "lost privileges". the municipal council of the international settlement found itself continuously involved in arguments, mostly sterile, over all sorts of questions of local interest, such as roads, police, taxes, jurisdiction, and so on, providing occasions where the chinese aptitude for obstruction had full play. the consequence was to alienate the sympathies of many of the leading foreigners in the main stronghold of foreign interests in china. according to professor reiner, an american economist who made a study of foreign investments in china in 1931, british business investments were distributed as follows: -- in shanghai 130, 000, 000 in hongkong 36, 000, 000 in the rest of china 30, 000, 000.

Attitude is everything in tournaments. truly. once you have mastered the basics, nothing will help you as much as a winning attitude that keeps you focused and keeps you from conceding or playing recklessly during the requisite hours of play. i've played in many tournaments, stud and hold `em, during the past 12 years or so that i've been a serious holdem poker player. though i've taken an occasional stab at the large , 000 + entry events, nearly all of my tournaments have been in the -500 range. i've won more than my share. there's been a lot of luck involved and some skill too to be sure. let me share with you some observations that have helped me win in these tournaments. i think you'll find the lessons i've learned in tournaments to be applicable to ring games as well. i remember reading words from a famous poker author who insisted that his students say to themselves, out loud, that a winning force surrounds them. it sounded corny then and it does now too. but there is something very powerful in deciding that you are a winning player. it is especially important in tournaments when you have a finite amount of chips at least after the re-buy period is over in rebuy tournaments ; . if you haven't learned to be successful in tournaments, here's what typically happens. you enter a tournament. you wait around a bit as the tournament is getting started. you are at least a little nervous about making sure that you play your best game for the duration of the event usually three to four hours in the relatively small events that i'm talking about. maybe you kibbutz with someone while you're waiting. then you start. you play very seriously at first playing your best game. you are tight and aggressive as you know you should be waiting for those premium pairs that you know to be highly valued and backing down from fights on third street when you think you are second best. you consider, seriously, what your opponents are likely to be holding. and you push hard when you think you have a large edge. then, typically, one of two things happens neither of them helpful. you win a few hands and your chip stack increases to more than average. or you lose a few contested hands and your stack sinks below par. either way, this throws you off your game somewhat. you start to play less thoughtfully and more wildly either pressing your perceived advantage or trying to recoup your lost stack. perhaps you get lucky and your stabs are fruitful and your stack grows and you start to dominate. sometimes this surge lasts all the way until the tournament is won and you are victorious. invariably, however, your loose, wild, or otherwise careless play is punished and you sink into oblivion. here's an alternate scenario. start thoughtfully from when you first sit down. don't engage in distracting conversation or prattle. focus fully on the task at hand and resolve to play your best game throughout. and then follow that plan. have a piece of paper with this affirmation on it if you want. "play best game, " or something similar, to literally remind you. when your chips sink or grow, keep reminding yourself of that. avoid thinking, "i'm too low to win i'll fling it in" or "i'm ready for the ring games this is a waste of time" or "i'm outgunned; it's time to go for broke." keep telling yourself that you will play only your best game and nothing else. sure, if your stack becomes depleted, you need to be more aggressive when the ratio of the antes to your stack grows. but make it an intentional aggression, not a wild one. think constantly about how you can win, not how you are bound to lose. this winning attitude, maintained consistently through each stage of the tournament, is the key to doing well in these tournaments. ashley adams is the author of winning 7-card stud, kensington press 2003 ; . he has been playing 7-card stud for 40 years--and profitably in casinos for the past 10 years. he has played in casinos all over the world, including england, denmark, sweden, austria, hungary, canada and the united states, but plays most frequently at at foxwoods resort casino in ledyard connecticut. professionally, he is a union organizer and an agent for broadcasters. he can be reached at: asha34 aol.

| First and foremost, making chips is a research-intensive endeavor. gordon moore calls it "an industry predicated on r&d."121 the industry was born out of a major scientific breakthrough followed by a spate of equally-important technological advances necessary to manufacture and commercialize semiconductor devices. important innovations such as the integrated circuit also were the product of research. the industry routinely invests 10 to 15 percent of revenues in r&d, even during periods of downturn.122 note that this is well above the national average of 5 percent for all industry. finally, the industry was an early initiator of industry-funded research consortia and now boasts one of the largest research consortia portfolios around the globe. at the same time, a very small amount of the total r&d budget is devoted to basic research, the very type of research that brought the industry into existence. this point was emphasized in the earlier rosenberg and steinmueller reference. thus the research focus is intensely on shorter-term development efforts, those involving the next product generation or two. the horizon of r&d activities has over time become shorter for a variety of reasons this will be discussed more in chapters 11 and 12 ; . in attempt to determine the possible influence of the roadmap on this trend, survey respondents for this study were asked whether the roadmap has qualitatively affected r&d expenditure patterns of the u.s. semiconductor industry emphasizing more "d" than "r" ; . in other words, has the roadmap shortened the research agenda horizon? the answers were mixed see answers to question #20 in appendix b ; but a few pointed out that the roadmap was not the primary cause of this: disagree, there is very little r in this industry anyway. agree disagree. in fact, more "d" than "r" happens, because that is directly funded by ic producers, and the sources of true "r" funds are scarce. remember, we don't have bell labs anymore, and ibm is not the altruistic think tank that it once was. that's true, but i don't blame the roadmap for that. i think it's more the environment this industry lives in. today market life cycles for products are very short, and they've got to hit those windows or they don't make any money. and so that drives the behavior which is afar from papers on fundamental understanding. so what's happened in industry at.

Rugby club limited treasurer's report 2004 the 2004 results reflect a more consistent trading performance than 2003. however without the enormous benefit of the world cup the overall result is not as good. the year's result for 2004 of a loss of , 934 was worse than the previous year's loss of , 401. however the revenue levels are on a more sustainable basis. the challenge for the club is for the ongoing trading results to continue to increase while controlling costs on a building that is high maintenance. the comparative trading results for last year clearly indicate that other than for the world cup in 2003, there have been some significant gains in the past 12 months. comparative trading results 2004 2003 $ $ gross revenue 1, 224, 511 divisional profits loss ; from bar 362, 005 402, holdem poker machines 231, 704 251, subscriptions 72, 627 60, other sources 236, 291 280, total 902, 627 995, less expenses 966, 561 ; 1, 026, 541 ; profit loss ; for the year 63, 934 ; 31, 401 ; the reduction in expenses was largely due to a cut in employee costs. costs will continue to be monitored so as to eliminate any waste and operate as efficiently as possible. bar trading was down, however given the impact of the world cup on last year's results, as mentioned in the president's report, there are some promising signs of a general and sustainable upturn. although it is not reflected in the attached results much of this upturn has occurred in the 2nd half of the year. a detailed look at the financial information illustrates how important it remains to continue to monitor costs while continually seeking ways to increase revenue. margins remain consistent. the statement of financial position highlights the importance of maintaining cash flow. the margin between current assets and current liabilities has not moved significantly however this is an area that needs constant monitoring. nevertheless given the total assets of the club the total level of liabilities is not high. i would like to take this opportunity to thank the board members and the staff for their efforts and trust that the club having consolidated in many areas are well placed to return to profitability in the short term ken wright j.p. m. comm fcpa.
